CPT 90834 is the code most outpatient therapy sessions actually land on once the clock is read honestly. It draws less audit attention than its 60-minute neighbour, and that is exactly why its errors survive for months. They rarely sit in the therapy. They sit in the modifier field, the place of service, and the other codes that end up on the same date.

CPT 90834 description and time frame

The CPT descriptor for 90834 is psychotherapy, 45 minutes with patient. Forty-five is the nominal length, not the requirement. A session qualifies for 90834 when face-to-face psychotherapy runs from 38 through 52 minutes.

That window has an edge on each side, and each edge sends the claim to a different code. A session that stops short of 38 minutes is 90832, whose own window opens at 16 minutes. A session that reaches 53 minutes is 90837. Contact under 16 minutes cannot be reported with any of the individual psychotherapy codes.

The scheduled appointment length proves nothing. The minutes written into the note are the only evidence a reviewer will accept.

90834 is the standalone code, used by any clinician the payer enrolls to provide psychotherapy: psychologists, clinical social workers, counselors and marriage and family therapists among them. A prescriber who also performs a separately identifiable evaluation and management service on the same day does not use it. In that visit the therapy is reported as an add-on to the E/M instead, and the add-on that matches the 90834 window is 90836.

CPT 90834 and 90837: where the line falls

Fifty-two minutes is 90834. Fifty-three is 90837. Because one minute separates codes with meaningfully different relative values, payers read that boundary as an audit signal from both directions. A clinician whose sessions cluster at exactly 53 minutes invites the same question as one who bills the longer code on every visit.

The defensible pattern is the honest one. Record the actual start and stop, bill whatever those minutes support, and let the mix of 90834 and 90837 across the caseload reflect real variation in how long sessions run. A panel billed entirely at one code, whichever code it is, reads like a template rather than a record.

Modifier rules for CPT 90834

Most 90834 claims need no modifier at all: an in-office session with nothing unusual about it goes out clean. Modifiers come in for three reasons. The session was delivered remotely, the payer needs to know who delivered it, or a second service on the same date has to be shown as distinct.

Telehealth modifiers

  • 95: the CPT modifier for a synchronous telemedicine service over real-time audio and video. It is the modifier commercial plans most often expect on a 90834 telehealth line, usually alongside place of service 02 or 10.
  • 93: the CPT modifier for a synchronous service by telephone or other real-time audio-only technology. In its CY 2022 fee schedule rule Medicare designated 93 as the audio-only marker for mental health services on professional claims.
  • FQ: the HCPCS modifier CMS describes as a service furnished using audio-only communication technology. It is the audio-only marker on rural health clinic and federally qualified health center claims, not on a private practice claim.
  • GT: the older HCPCS audio and video modifier. Some Medicaid programmes and older commercial contracts still name it in their telehealth policy, so whether a payer wants 95 or GT is a contract setting. Sending the wrong one is a rejection that costs a full resubmission cycle.

Provider and program modifiers

  • AH and AJ: HCPCS modifiers for a clinical psychologist and a clinical social worker, used where a payer wants the provider type on the claim line.
  • HO, HP and HN: master's, doctoral and bachelor's degree level. State Medicaid programmes use them to price the same 90834 differently by the rendering clinician's education, so the wrong one underpays rather than denies.
  • HA, HE and HK: child and adolescent program, mental health program, and specialized programs for high-risk populations. These are state-defined and mean nothing to Medicare.

Distinct-service modifiers

  • 59, XE, XP, XS and XU: these release an NCCI pair only where the pair's indicator is 1. On a 90834 claim that mostly means a family or group session delivered during a separate time interval on the same date. Against a pair set at 0 they do nothing.
  • 25: belongs on an E/M line and is never appended to 90834.

Interactive complexity, 90785, is not a modifier but an add-on code. No NCCI edit blocks it alongside 90834, and it still needs a named qualifying factor in the note.

Documentation requirements

  • Session minutes. Clock start and stop times, or a stated total of face-to-face psychotherapy minutes, landing inside the 38 to 52 minute window.
  • The intervention, named, and what the clinician actually did with it in this session rather than a description of the approach in general.
  • The diagnosis treated, consistent with the treatment plan and with the diagnosis on the claim.
  • Observations from today: presentation, mental status and symptom change, so a reader can see where the patient is now.
  • Progress against the plan's goals, including where it has stalled and what is changing as a result.
  • Telehealth facts when the session was remote: audio-video or audio-only, where the patient was, and for audio-only why video was not used. From 2028, Medicare's audio-only rule for behavioral health turns on exactly that point.
  • Who was present. A family member joining as an informant stays inside 90834. A separate family session is a separate code with its own time.

Common denials and the exact fix

Session under 38 minutes billed as 90834

On review the recorded minutes support 90832, so the payer reprices the line or recoups the difference months later, often across a whole sample of visits.

Fix: put the time check into charge entry. A 90834 with fewer than 38 documented minutes should never leave the practice.

90834 and an office visit on the same claim

Medicare pairs 90834 against 99202 to 99215 at modifier indicator 0, and against the audio-video and audio-only E/M codes 98000 to 98016 as well. No modifier opens that pair.

Fix: when a prescriber evaluates and then provides 38 to 52 minutes of therapy, bill the E/M at the level its medical decision making supports and report the therapy with add-on 90836.

Therapy billed on the day of the diagnostic evaluation

90791 and 90792 sit in column one against 90834 at indicator 0. NCCI's reasoning is that psychotherapy already includes continuing psychiatric evaluation, so the two cannot share a date.

Fix: bill the evaluation alone on intake day and start reporting 90834 from the next session.

Audio-only session sent with modifier 95

95 states that video was used. When the session was by phone, the claim misdescribes the service, and on a later review that is a documentation failure rather than a coding slip.

Fix: let the note drive the modifier. Audio-only goes out with 93 on a professional claim, or FQ from a rural health clinic or federally qualified health center.

Medicaid line missing the licence level modifier

Where a state prices 90834 by credential, a line without HO, HP or HN either rejects or pays at the lowest tier.

Fix: keep a per-payer map from each rendering clinician's credential to the modifier that payer requires, and apply it at charge entry rather than from memory.

NCCI bundling edits for 90834

From the Medicare practitioner procedure-to-procedure file effective October 1, 2026. At indicator 0 the pair can never be billed together; at indicator 1 a modifier may release it when the services were genuinely separate.

  • 90834 over 90832 and 90833: indicator 0, mutually exclusive. The reverse direction holds too: 90836, 90837 and 90838 sit over 90834 at 0.
  • 90791 and 90792 over 90834: indicator 0, a CMS coding instruction.
  • 90834 over 99202 to 99215 and 98000 to 98016: indicator 0.
  • 90834 over crisis codes 90839 and 90840: indicator 0.
  • 90834 over 90845, 90875 and 90876: indicator 0; hypnotherapy, 90880, sits over 90834 at 0 as the more extensive service.
  • 90834 over 96127: indicator 0, rationale misuse of the column two code.
  • 90834 over the health behavior intervention codes 96158, 96159, 96164, 96165, 96167 and 96168: indicator 0.
  • 90834 over the adaptive behavior codes 97151 to 97157: indicator 0.
  • Family and group psychotherapy over 90834 (90846, 90847, 90849, 90853): indicator 1, separate time interval required.
  • 90834 over 96116, the TMS codes 90867 to 90869, and G0444: indicator 1.

Local coverage: is there an LCD for this code?

There is no national coverage determination for psychotherapy or psychiatric evaluation, so coverage is set locally and it differs by jurisdiction. Several Medicare Administrative Contractors publish a local coverage determination for psychiatric services together with a billing and coding article that carries the actual code list. Novitas Solutions, for example, maintains LCD L35101 (Psychiatric Codes, effective January 1, 2024) with billing and coding article A57130, which is where the covered CPT and HCPCS codes and the covered diagnoses actually live.

Two practical consequences. First, the diagnosis list that supports CPT 90834 in one jurisdiction may not support it in another, so the article to read is the one from the contractor that processes your claims. Second, LCDs and their articles are revised without much notice, which is why a claim that paid last quarter can deny this quarter with nothing changed on your side. Search the CMS Medicare Coverage Database by code and by your contractor, and re-check it when a denial pattern appears.

CPT 90834 reimbursement

Medicare does not publish a single national price for 90834. It publishes relative values, which each locality's geographic indices then adjust, so two practices billing the same session in different states are paid different amounts. The relative values, the Medicare unit limit and the conversion factor are below. Commercial and Medicaid rates are whatever the contract or the state fee schedule says, and commercial contracts are often written as a percentage of the Medicare amount.

Source: CMS CY 2026 PFS Relative Value File, RVU26D (October release, published 08/26/2026). RVUs are national and unadjusted; commercial and Medicaid payers set their own rates and their own coverage.

In the 2026 CMS relative value file, CPT 90834 carries 2.56 work RVUs, with 3.41 total RVUs in a non-facility setting and 2.75 in a facility. The gap is practice expense: in an office the practice carries it, in a facility the facility does. Its PC/TC indicator is 0: CMS treats it as a physician service, so modifiers 26 and TC do not apply to it in any setting. Its global indicator is XXX: the surgical global period concept does not apply, so there is no postoperative period bundling other services into it. Across the individual psychotherapy codes, work RVUs run from 1.94 (90832) to 3.78 (90837); 90834 sits at 2.56.

Units per day. Medicare's medically unlikely edit allows up to 2 units of CPT 90834 per patient per day (a date of service edit set on clinical grounds, rationale: clinical: CMS workgroup). MUE values are published quarterly in the Medicare NCCI practitioner services MUE table; the value above is from the table effective October 1, 2026.

To turn RVUs into payment, each component is multiplied by your locality's geographic practice cost index, the three are added, and the sum is multiplied by the 2026 conversion factor: $33.4009, or $33.5675 for qualifying APM participants (CMS-1832-F; CMS fact sheet). The CMS Physician Fee Schedule Look-Up Tool runs that calculation for your own locality.

Frequently asked questions

What modifier is used with CPT 90834 for telehealth?
Modifier 95 for a session delivered by real-time audio and video, which is what most commercial plans expect. For an audio-only session, Medicare's marker on professional claims is modifier 93, and rural health clinics and federally qualified health centers use FQ. For Medicare the place of service carries the rest: 10 when the patient is at home and 02 anywhere else. A few Medicaid programmes and older contracts still ask for GT, so check the payer's own telehealth policy.
What is the time frame for CPT 90834?
38 to 52 minutes of psychotherapy with the patient. Below 38 minutes the session is 90832, which starts at 16 minutes, and at 53 minutes or more it is 90837. The descriptor says 45 minutes, but the billable range comes from the CPT time rule, and only time spent in psychotherapy with the patient counts toward it.
What is the difference between CPT 90834 and 90837?
Only the documented length. 90834 covers 38 to 52 minutes and 90837 covers 53 minutes or more, and Medicare treats the two as mutually exclusive on the same date. 90837 carries more relative value, which is why payers watch the ratio between the two codes across a clinician's caseload.
Is there an LCD for CPT 90834?
There is no national coverage determination for psychotherapy, so coverage sits with each Medicare Administrative Contractor. Novitas Solutions, for example, publishes LCD L35101 for psychiatric codes with billing and coding article A57130, which holds the covered diagnosis list. Read the article from the contractor that processes your claims, because the diagnoses that support 90834 are not identical everywhere.
Can CPT 90834 be billed on the same day as an office visit?
Not as two separate codes. Medicare pairs 90834 against the office visit codes 99202 to 99215 at modifier indicator 0, so no modifier releases the pair. A prescriber who provides a separately identifiable E/M service and 38 to 52 minutes of psychotherapy bills the E/M with add-on code 90836 instead.
