3. Eligibility to Use Services

By engaging our services, clients represent that they possess lawful authority to share administrative or healthcare-related information required for service delivery.

4. Business Associate Relationship

Where services involve Protected Health Information (“PHI”), Sterling Global Solutions LLC operates as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA).

Processing of PHI shall occur only after execution of a valid Business Associate Agreement (BAA) between the Company and the Covered Entity.

In the event of any conflict between these Terms and an executed BAA, the BAA shall govern PHI-related obligations.

5. Client Responsibilities

Clients agree to:

Provide accurate and complete information necessary for service performance.
Maintain compliance with applicable federal and state healthcare laws.
Retain responsibility for all medical decisions and patient care.
Ensure lawful authorization for data shared with the Company.
Maintain appropriate system access credentials under their control.

Sterling Global Solutions LLC shall not be responsible for errors resulting from inaccurate or incomplete information provided by clients.

6. Scope Limitations

The Company’s responsibilities are limited strictly to administrative support functions agreed upon in written service agreements.

The Company does not guarantee:

Insurance reimbursement outcomes
Claim approval decisions
Payment timelines
Payer determinations
Revenue increases

Insurance payment decisions remain solely under the authority of payers and regulatory bodies.

7. Confidentiality Obligations

Both parties agree to maintain confidentiality regarding all non-public information exchanged during business operations.

Confidential information includes:

Business data
Operational processes
Patient-related administrative information
Financial information
Proprietary workflows

Confidential information shall not be disclosed except:

As required by law
With written authorization
For legitimate service execution purposes

Confidentiality obligations survive termination of services.
